Over the course of his career, spanning over 35 years, Mr. Hayden has represented a wide variety of employers, from family businesses and start-ups to Fortune 500 companies, including printers, newspapers, HMO’s, importers, manufacturers, construction companies and trucking companies. Mr. Hayden represents employers in connection with a broad range of labor and employment matters, including collective bargaining negotiations, grievances and arbitrations under collective bargaining agreements. He represents employers in employment litigation, including wrongful termination, employment discrimination and administrative wage claims, as well as non-competition and trade secret litigation and advice. He also advises and represents employers in investigating and responding to claims of discrimination before the California Department of Fair Employment and Housing and the federal Equal Employment Opportunity Commission. He provides advice on daily workplace and personnel issues as well as employment law considerations in mergers, acquisitions and sales of business units.
Mr. Hayden is also experienced in the resolution of business and partnership disputes through informal negotiation, mediation, and if necessary, litigation or binding arbitration. Additionally, as in-house counsel for two healthcare entities, he developed and conducted employee compliance programs, reviewed and negotiated contracts and billing agreements with vendors, subcontractors, and strategic partners. He continues to provide these services for various clients of this firm.
Mr. Hayden is admitted to practice before all of the Courts of the State of California, the United States District Courts for the Central, Northern, and Southern Districts of California, and the Ninth Circuit Court of Appeals, and he has extensive experience in both State and Federal Courts. Representative matters include:
- Defeated Class Certification Motion in wage and hour class action, and successfully defended denial of the motion on appeal
- Succeeded in transferring wage and hour class action from federal court to arbitration, resulting in quick and favorable settlement
- Numerous favorable settlements in wage and hour class action litigation for employers in a range of industries
- Defended a charity’s right to raise millions of dollars through an annual San Francisco to Los Angeles bicycle ride by defeating an event promoter’s motion to enjoin the ride.
- Successful arguments before the Ninth Circuit in cases with issues arising under union collective bargaining agreements
